1. Acceptance of Terms
By accessing or using the services provided by William Hayes Group (“WHG,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.
2. Scope of Services
WHG provides financial education, consulting, and file preparation services for individuals seeking debt relief solutions. Our role is to:
- Educate clients about debt relief and financial management.
- Assist clients in gathering financial information, preparing documentation, and understanding options.
- Provide recommendations regarding debt relief pathways, including consumer proposals and bankruptcies.
- Refer clients to Licensed Insolvency Trustees (LITs) or other third-party providers when appropriate.
WHG is not a Licensed Insolvency Trustee and does not administer insolvency proceedings. Only a Licensed Insolvency Trustee can file or manage a consumer proposal or bankruptcy under Canadian law.
3. Fees and Payments
WHG charges administrative and consulting fees for the preparation of client files and related services. These fees are not payments for entering a consumer proposal, bankruptcy, or other insolvency process. WHG does not charge referral fees for directing clients to Licensed Insolvency Trustees or other partners.
All fees will be disclosed in writing before services are provided. Payments are due according to the terms outlined in the client’s agreement with WHG.
4. Client Responsibilities
Clients agree to:
- Provide complete and accurate information about their financial situation.
- Promptly supply documents and records requested for file preparation.
- Acknowledge that any estimates provided by WHG are for planning purposes only, and final determinations are made by Licensed Insolvency Trustees.
5. SMS and Electronic Communications
By providing your phone number or email address, you consent to receive communications from WHG, including SMS messages. These may include reminders, updates, educational materials, and promotional offers. Message frequency may vary. Standard message and data rates may apply.
You may opt out of SMS marketing at any time by replying “STOP” to a message. Essential service-related messages will still be sent where required.
6. Third-Party Services and Referrals
WHG may refer clients to Licensed Insolvency Trustees, credit rebuilding services, or other third-party providers. WHG is not responsible for the services or decisions of third parties. Clients should review the terms and conditions of any third-party provider before engaging their services.
7. Limitation of Liability
WHG provides consulting and educational services on an “as is” basis. While we strive to provide accurate and useful information, we make no guarantees about outcomes in insolvency processes or creditor negotiations. WHG is not responsible for actions taken by Licensed Insolvency Trustees, creditors, or other third parties.
To the maximum extent permitted by law, WHG disclaims all liability for damages, including direct, indirect, incidental, or consequential losses arising from the use of our services.
8. No Legal or Financial Advice
WHG provides financial education and consulting services but does not provide legal or investment advice. Clients are encouraged to seek independent legal, financial, or tax advice as appropriate.
9. Privacy
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our privacy practices, including the use of SMS marketing as described in that Policy.
10. Amendments
WHG may update these Terms of Service at any time. Updates will be effective when posted on our website or otherwise communicated to clients. Continued use of our services after changes means you accept the revised terms.
11. Governing Law
These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
